2. Applicable data-protection law

Personal data is processed in accordance with the Swiss Federal Act on Data Protection and, where applicable, the General Data Protection Regulation of the European Union and other applicable data-protection laws.

3. Data processed when visiting the website

When this website is accessed, the hosting provider may process technical information required to deliver, operate and protect the website, including:

  • IP address or an anonymised form of the IP address
  • date and time of access
  • requested page or file
  • referrer information
  • browser type and version
  • device and operating-system information
  • error, security and server-log information

This information is processed to provide the website, maintain technical security, detect misuse and investigate technical errors.

  • parent or guardian details where the applicant is under 18
  • ballet school, education, training and professional experience
  • participation profile and requested attendance period
  • scholarship requests and motivation
  • portrait and dance photographs
  • audition-video links
  • uploaded documents and professional proof
  • requested optional services
  • information supplied in free-text fields
  • consent and acceptance records
  • technical submission and security information
  • application reference and payment status

Applicants should provide only information relevant to their application. Unnecessary medical documents or other highly sensitive information should not be submitted unless ART of specifically requests the information and provides an appropriate submission method.

6. Purposes of processing

Personal and application data may be used to:

  • receive and review applications
  • assess artistic level and programme suitability
  • determine available capacity
  • communicate admission decisions
  • assign participants to appropriate groups
  • administer scholarships and professional rates
  • organise course participation and optional services
  • communicate with applicants, parents and guardians
  • protect participants and meet safeguarding responsibilities
  • document consent and acceptance of the Terms and Conditions
  • process and reconcile application and course payments
  • prevent spam, fraud and misuse
  • establish, exercise or defend legal claims
  • comply with accounting and other legal obligations

7. Legal grounds

Depending on the circumstances and applicable law, processing may be based on:

  • steps requested before entering into a contract
  • performance and administration of a contract
  • compliance with legal obligations
  • legitimate interests in operating, securing and organising ART of programmes
  • consent where consent is legally required
  • protection of the vital interests of a participant in an emergency

Where consent is the relevant legal basis, it may be withdrawn for future processing. Withdrawal does not affect processing that occurred lawfully before the withdrawal.

8. Applicants under 18

Where an applicant is under 18, ART of collects parent or guardian information and the required authorisations.

Parents or guardians should ensure that the information submitted for a minor is accurate and that they are authorised to provide it.

ART of may contact the parent or guardian to verify consent, participation arrangements, safeguarding information or other matters relevant to the minor’s application and attendance.

9. Application decisions

Admission and scholarship decisions are made through individual human assessment.

ART of does not use solely automated decision-making or automated profiling to determine admission or scholarship awards.

Submitting an application does not create a right to admission or financial support.

10. Application-file security

Uploaded application files are stored outside the publicly accessible website directory.

Security measures include:

  • encrypted HTTPS transmission
  • server-side file-type and file-size validation
  • randomly generated stored filenames
  • restricted administrative access
  • password-protected application administration
  • CSRF protection
  • rate limiting
  • Cloudflare Turnstile bot protection
  • separation of public website files and private application storage

Application files are not intentionally published and should not be included as ordinary email attachments. Authorised ART of personnel access the files only where required for application review, administration, safeguarding or legal purposes.

No internet transmission or storage system can guarantee absolute security. ART of nevertheless applies reasonable technical and organisational measures appropriate to the nature of the information processed.

11. Email notifications and communication

After an application is submitted, ART of may receive an administrative email containing the application reference and relevant application information.

Uploaded application files should be accessed through the protected server workflow rather than being attached to ordinary notification emails.

Email transmission is normally protected in transit where supported by the participating email providers. Standard email is not necessarily end-to-end encrypted.

13. Cloudflare Turnstile

The application form uses Cloudflare Turnstile to distinguish legitimate human submissions from automated abuse.

Turnstile may process technical information concerning the browser, device, network connection and interaction with the security check. This information is processed for website security and abuse prevention.

Cloudflare may process information outside Switzerland or the European Economic Area under the safeguards described in its applicable privacy documentation.

14. PayPal payments

Application fees and other authorised payments may be processed by PayPal.

Payment credentials, card details and PayPal passwords are entered directly into PayPal’s systems. ART of does not receive or store those credentials.

ART of may receive:

  • payer name and email address
  • payment reference
  • amount and currency
  • transaction identifier
  • payment status
  • invoice or application reference

PayPal processes personal data independently under its own terms and privacy statement.

15. Photographs, videos and media use

Photographs and videos submitted as part of an application are used to assess the application. Their submission does not automatically authorise promotional publication.

Possible use of participant photographs or recordings for websites, social media, publicity or other promotional purposes is handled separately and requires an appropriate legal basis or consent where required.

Consent for future optional promotional use may be withdrawn by contacting ART of. Withdrawal does not affect processing or publication that occurred lawfully before the withdrawal or processing supported by another applicable legal basis.

16. Recipients

Personal data may be accessed or disclosed, where necessary, to:

  • authorised ART of personnel
  • confirmed artistic or administrative staff involved in assessment or course organisation
  • hosting, email, security and technical-service providers
  • PayPal and other authorised payment providers
  • professional advisers where legally necessary
  • public authorities where disclosure is required by law
  • venues or programme partners where limited information is necessary for participation, access or safeguarding

ART of does not sell applicant data or provide application files to third parties for unrelated advertising.

17. International data transfers

Some service providers may process data outside Switzerland or the European Economic Area.

Where required, ART of relies on an adequacy decision, recognised contractual safeguards, standard contractual clauses, explicit consent or another legally permitted mechanism.

The destination countries and applicable safeguards may depend on the service provider used at the time of processing.

18. Retention

Personal data is retained only for as long as it is reasonably required for the purpose for which it was collected or for an applicable legal, contractual, safeguarding or evidential requirement.

As a general policy:

  • incomplete and unsuccessful applications are deleted or anonymised within 12 months after the end of the relevant course edition
  • admission photographs, audition material and other artistic application files of accepted participants are normally deleted within 12 months after the course
  • essential participant, contractual, consent and safeguarding records may be retained for up to five years after the course where reasonably required
  • invoices, payment records and accounting documents may be retained for ten years where required by law
  • information relevant to a dispute, outstanding payment or legal claim may be retained until the matter and applicable limitation periods have ended
  • security, session and rate-limit records are retained only for the period necessary to operate and protect the service
  • backup copies are removed through the applicable backup-rotation cycle

Where only part of a record must be retained, ART of may delete unnecessary photographs, videos and documents while retaining the limited information required for legal, accounting, contractual or safeguarding purposes.

19. Cookies and similar technologies

This website may use strictly necessary cookies or comparable technologies for:

  • form-session management
  • CSRF protection
  • administrator login
  • security and rate limiting
  • Cloudflare Turnstile
  • remembering whether the privacy notice has been dismissed

These technologies are necessary for the security and operation of the website.

Optional analytics, advertising or marketing technologies will be activated only where the legally required consent configuration has been implemented.

ART of does not use application data for behavioural advertising.

20. External links and embedded content

The website may link to or contain content from external services such as PayPal, YouTube, Vimeo, social networks, programme partners or accommodation providers.

When an external link is opened or external content is activated, the relevant provider may process personal data under its own privacy policy.

Privacy-conscious or consent-based embedding is used where technically available and legally required.

21. Data-protection rights

Subject to applicable law, individuals may have the right to:

  • obtain a copy of relevant personal data
  • correct inaccurate or incomplete data
  • request deletion
  • request restriction of processing
  • object to certain processing

ART of may require reasonable information to verify the identity of the person making the request and to prevent personal data from being disclosed or deleted at the request of an unauthorised person.

A deletion request does not necessarily require the deletion of every record. ART of may retain limited information where processing is required by law or remains necessary for accounting, contractual obligations, safeguarding, outstanding payments, dispute resolution or the establishment, exercise or defence of legal claims.

Where possible, information that is no longer required will be deleted or anonymised.
