Course dates, tuition and payment deadlines stated in the written admission offer form part of these terms.

1. Organiser and scope

ART of - Madrid Ballet Intensive is organised by Klymyuk, ART of, Pfingstweidstrasse 31, 8005 Zurich, Switzerland, company register number CHE-396.840.801 ("ART of", "we", "us"). These Terms and Conditions apply to applications, admission and participation in ART of Madrid. Edition-specific information in the written admission offer, including dates, tuition, deadlines and any expressly agreed additional services, forms part of the agreement.

2. Programme and educational character

ART of - Madrid Ballet Intensive is an intensive educational dance programme. The programme may include classical ballet, repertoire, pointe or technique work, choreographic workshops, William Forsythe-related movement work, dance/sport science, individual coaching and other artistic or professional-development activities. The exact daily schedule, faculty, repertoire, rooms and class order may vary by edition.

3. Eligibility and minimum age

The standard minimum age is 14 years on the first day of the course unless ART of confirms an exception in writing. Applicants must have a training level appropriate to the selected pathway. Professional Dancer and Observation Class applicants may be asked for evidence of professional status, teaching practice or other relevant experience.

4. Application

An application must be complete, accurate and submitted through the designated application process. The applicant is responsible for ensuring that uploaded photographs, videos, CVs and other materials may lawfully be submitted and do not infringe third-party rights. ART of may request additional information or updated artistic material before making an admission decision.

5. Application fee

The application fee is EUR 40, plus any separately disclosed third-party payment fee. It is due after successful submission of the application and is separate from course tuition. The application fee is non-refundable once the application has been received and assessment has begun, except where mandatory law requires otherwise.

6. Assessment and admission

Submitting an application does not create a right to admission. ART of assesses current technical and artistic level, programme fit, age, group balance and available capacity. Admission is confirmed only in writing by ART of. Any indication made before written admission is provisional.

7. Course fee, payment and confirmation of place

The applicable tuition and payment deadline are stated in the written admission offer. Unless the offer states otherwise, tuition is due within 14 days of the admission notice. A place becomes binding when the required tuition has been received by the deadline. If payment is late, ART of may release the place after reasonable notice. Bank, card, PayPal, exchange-rate or intermediary charges are the participant's responsibility unless stated otherwise.

8. Attendance period and pathway

Where one-week and two-week attendance are offered, the participant selects the attendance period independently of status. Professional Dancer status does not automatically require two-week attendance. Admission, grouping and access to particular activities remain subject to the participant's level and the edition's programme structure.

9. Professional Dancer rate

The Professional Dancer rate is intended for dancers who currently hold, or previously held for more than one year, a professional dance-company contract, unless the written offer specifies otherwise. Proof may be required. ART of may decline the reduced rate where the stated criteria are not met without affecting an otherwise valid application at the appropriate fee.

10. Observation Classes

Observation Classes are intended for dance teachers, pedagogues, rehearsal directors, professional dancers developing their teaching practice and relevant dance/sport professionals. Observation is educational and does not grant the right to teach, record, reproduce exercises, interfere with classes or access confidential participant information. Observers must follow safeguarding, privacy and venue instructions.

11. Professional, company and audition opportunities

ART of may create opportunities for selected dancers to meet or work with choreographers, ballet directors, company artists or other professionals. During the first week of ART of - Madrid Ballet Intensive, selected dancers may be invited to join company class with Compañía Nacional de Danza during the second week, offering an opportunity to experience the rhythm, expectations and working environment of a professional ballet company. Selection and participation are subject to confirmation for the respective edition. No company class, audition, contract, scholarship, employment or other professional outcome is guaranteed unless expressly confirmed in writing.

12. Faculty, repertoire, schedule and programme changes

Teachers, coaches, choreographers, repertoire, studios, class times and order of activities may change for artistic, operational, health, safety or availability reasons. ART of will use reasonable efforts to maintain the essential educational character and level of the programme. A change of individual faculty member, studio, class order or repertoire does not by itself constitute cancellation of the course.

13. Participant withdrawal and cancellation

Withdrawal must be communicated in writing. Unless a different schedule is stated in the written admission offer, and always subject to mandatory law: for cancellation at least three months before the first course day, 50% of paid tuition is retained and 50% refunded; for cancellation less than three months but at least one month before the first course day, 70% is retained and 30% refunded; for cancellation less than one month before the first course day, tuition is non-refundable. The application fee is treated separately under section 5. Any bank or payment-provider charges that cannot be recovered may be deducted from a refund where legally permitted.

14. Illness, injury and missed participation

Participants are responsible for arriving medically fit to train. Illness, injury, travel disruption, visa problems, late arrival, early departure or voluntary absence do not normally entitle the participant to a refund or replacement classes, except where mandatory law provides otherwise or ART of agrees otherwise in writing. ART of may request medical information reasonably necessary to protect the participant or others.

15. Cancellation or rescheduling by ART of

If ART of cancels the entire programme and does not provide a reasonable replacement or rescheduled option, tuition paid for the cancelled programme will be refunded, subject to mandatory law. ART of is not responsible for independently booked travel, accommodation, insurance or other third-party costs unless liability cannot legally be excluded.

16. Events beyond reasonable control

If an event outside ART of's reasonable control materially prevents or restricts performance, including government restrictions, venue closure, serious public-health events, natural disaster, transport-system disruption or comparable circumstances, ART of may adapt, postpone, relocate or, where appropriate, cancel affected elements. ART of will act reasonably and communicate material changes. Any refund, credit or alternative offered will take account of services already provided, unavoidable costs and applicable mandatory law; this clause does not remove non-waivable consumer rights.

17. Health and physical demands

Dance training involves risk of injury. Participants must disclose relevant limitations when reasonably necessary for safe participation and must follow faculty and safety instructions. Participation while injured or medically unfit is at the participant's own risk, subject to ART of's non-excludable legal duties. ART of may restrict participation where reasonably necessary for health or safety.

18. Insurance

Participants are responsible for adequate health, accident, travel and personal-liability insurance valid in Spain for the full period of travel and participation. Insurance should cover dance training and, where relevant, cancellation or interruption. ART of does not provide individual insurance unless expressly confirmed in writing.

19. Conduct, safeguarding and exclusion

Participants must behave respectfully, follow venue and safeguarding rules, comply with reasonable instructions and avoid conduct that endangers, harasses or materially disrupts others. Serious or repeated misconduct may lead to removal from a class or exclusion from the programme after consideration of the circumstances. Where exclusion results from the participant's serious misconduct, tuition is not normally refunded, subject to mandatory law.

20. Minors

For participants under 18, a parent or legal guardian must provide the required consent and accurate emergency-contact information. The parent or guardian remains responsible for travel, accommodation, meals and supervision outside published programme hours unless ART of expressly agrees otherwise in writing.

21. Travel, visas, accommodation and meals

Unless expressly included in the written offer, travel, visa or entry requirements, accommodation, local transport and meals are not included in tuition and remain the participant's responsibility. Admission to ART of does not guarantee a visa or entry permission. Participants should use flexible or insured bookings where possible.

22. Recording by participants and observers

Photography, audio recording or video recording during classes, rehearsals, coaching or other non-public programme activities is prohibited unless ART of and, where relevant, the teacher/choreographer and affected participants have given permission. Repertoire, exercises and teaching material may be subject to copyright and other rights.

23. Organiser photography and video

Any use of an identifiable participant's image, voice or recording for promotional or other consent-based purposes is handled separately from admission where consent is legally required. Refusing optional promotional consent does not affect admission. Consent may be withdrawn for future use in accordance with the applicable privacy information, without affecting lawful use already made before withdrawal.

24. Optional Media Service

Where a participant purchases an optional photo or video service, the scope, price and deliverables shown for the relevant edition apply. Delivery times may vary according to production workload. Personal-use rights in delivered participant media are granted as stated with the service; third-party music, choreography, venue and performer rights may restrict commercial publication or further use.

25. Scholarships and reductions

Scholarships and fee reductions are edition-specific, limited and discretionary unless expressly promised in writing. They normally apply only to the stated portion of tuition and do not cover the application fee, travel, accommodation, meals, insurance or other costs unless explicitly stated. No scholarship is guaranteed by submitting an application.

26. Intellectual property and repertoire

Course materials, choreography, repertoire, exercises, texts, photographs, video, branding and other protected content remain subject to the rights of ART of and/or the respective creators and rights holders. Participation does not transfer intellectual-property rights. Private study does not imply permission for public performance, commercial exploitation, teaching reproduction or online publication.

27. Personal data and privacy

Personal data is processed for application assessment, programme administration, communication, payment/security purposes and legal obligations as described in the current Privacy Information. Sensitive or optional information is processed only where there is an appropriate legal basis. Payment providers process payment data under their own terms and privacy notices.

28. Third-party services and payments

ART of may use hosting, email, file-storage, payment, security or other technical service providers. PayPal or another payment provider may impose its own terms, authentication and fees. A payment-provider receipt does not replace ART of's admission decision or written confirmation of the course place.

29. Liability

ART of is liable in accordance with applicable law. Nothing in these terms excludes or limits liability where such exclusion or limitation is prohibited, including liability that cannot lawfully be excluded for intentional or grossly negligent conduct. To the extent permitted by law, ART of is not responsible for loss caused by the participant's own conduct, undisclosed medical limitations, independent third-party services or events outside ART of's reasonable control.

30. Complaints and corrections

Questions, errors in an application, payment issues or complaints should be sent promptly to madrid@art-of.net so that ART of has a reasonable opportunity to investigate and respond. Urgent health or safeguarding concerns should be raised immediately with the responsible course staff.

31. Mandatory consumer rights

These terms do not limit mandatory consumer rights. Any statutory withdrawal, cancellation, refund, information or jurisdiction rights that apply under mandatory law take precedence over conflicting contractual wording.

32. Applicable law and jurisdiction

To the extent legally permitted, the agreement is governed by Swiss law. Mandatory consumer-protection and jurisdiction rules applicable to the participant remain unaffected. Nothing in this clause deprives a consumer of protections that cannot legally be waived by choice of law or forum.

33. Final provisions and current edition

If one provision is invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law. The written admission offer, these Terms and Conditions and any expressly incorporated edition-specific information form the agreement concerning participation. Material changes after booking will not be applied retroactively to the participant's disadvantage where prohibited by law.
